These terms govern your use of the services provided by ServerNeed ("we", "us", "our"), a Bangladesh company operating under Trade Licence No. 949. By purchasing or using any of our services, or by creating an account, you agree to be bound by them.
If you do not agree to these terms, please do not use our services. Your use is also governed by our privacy policy, acceptable use policy and refund policy, which form part of this agreement.
We provide domain registration and transfer, shared, WordPress, cloud and reseller hosting, virtual and dedicated servers, web development and business software.
What each service includes — its resources, its billing terms and any limits — is described on the page you buy it from and confirmed at checkout before anything is charged. We provide the service stated for the price agreed at the time of purchase, with no hidden costs added afterwards. Where a setup fee applies it is shown before you pay, not after.
Dedicated servers are quoted individually rather than sold as fixed plans; the terms of an individual quote apply in addition to these.
To hold an account with us:
We may ask you to verify your identity or your payment method for certain transactions. This protects both of us against fraud, and a transaction may be held until verification is complete.
Billing is based on the plan and billing cycle you select at checkout, and payments are taken through the payment methods available there. Your price is re-confirmed against our billing system at checkout before anything is charged.
Services renew on the cycle you chose unless you cancel. We send invoices and renewal notices in advance to the email on your account, so keeping that address current matters.
We may change our pricing. A change never affects a term you have already paid for; it applies from your next renewal, and we will tell you before that renewal falls due. Cancelling partway through a billing period does not entitle you to a partial refund for that period, beyond what our refund policy provides.
Your use of our services is governed by our acceptable use policy, which forms part of this agreement and which you should read.
In short: you agree not to use our services for anything illegal, abusive or harmful — including spam, malware, phishing, and infringement of other people's rights. Attempts to harm, gain unauthorised access to, or otherwise abuse a server — ours or anyone else's — are strictly prohibited, and may result in warning, suspension or termination without a refund.
You agree to use your service within the resources your plan allocates, and in a way that does not degrade the performance, stability or security of our systems or of other customers.
You are responsible for monitoring your own storage and bandwidth usage. If your account exceeds its plan limits we will contact you, and you will have the option to upgrade or to reduce usage, before we take any further action — except where the usage is causing immediate harm to other customers and we have to act first.
Domain registrations, renewals and transfers are subject to the rules of the relevant registry and registrar, and to ICANN's policies where they apply. Those rules bind you as the registrant, and they are not ours to waive.
Registering a domain requires us to submit your registrant contact details to the registry — see our privacy policy. You are responsible for keeping those details accurate; an inaccurate registrant record can cost you the domain under registry rules.
A domain must be renewed before it expires. We send renewal notices in advance, but the registration is yours to keep current, and we are not responsible for a domain lost to non-renewal or for actions taken by a registry or registrar.
Where a hosting plan includes backups, the schedule is stated in that plan's own description and on the page you buy it from. Our VPS plans do not state a backup schedule, and you should not assume one.
Whatever your plan includes, you remain responsible for keeping your own copies of your data. Backups are a convenience, not a guarantee: we cannot promise that a backup will exist, be current, or be recoverable in every situation, and we do not guarantee data recovery.
If your data matters to your business — and it does — keep an independent copy somewhere we do not control.
We may suspend or terminate an account or a service that breaches these terms or our acceptable use policy, or where activity on it is harming our systems, our other customers or third parties. Where the circumstances allow it we will warn you first; where they do not — an active attack, for example — we may act immediately and tell you afterwards.
We may also suspend a service for non-payment after the notices we send have gone unanswered.
Outside a breach, you can cancel at any time from your account. Cancellation takes effect at the end of your current billing period unless we agree otherwise, so you keep what you have paid for.
Refunds and cancellations are handled under our refund policy, which sets out what is refundable, what is not, and in what period. Please read it before you buy.
Domain registrations are generally non-refundable once registered, because the registry fee is paid at that point and is not returnable to us. Services terminated for a breach of these terms are not refunded.
The ServerNeed name and logo, this website, and the content and materials we produce are our property or that of our licensors. You may not copy, redistribute or reuse them without permission.
What you upload stays yours. Your websites, databases, files and other content remain your property. You grant us only the permission we need in order to host, transmit, back up and support that content — nothing beyond running the service you have bought — and you confirm you have the rights to the content you put on our servers.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of our services — including lost profits, lost business, or loss or corruption of data.
Where we are liable, our total liability for any claim is limited to the fees you paid us for the affected service in the twelve months before the claim arose.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including for death or personal injury caused by negligence, or for fraud. Where your local consumer law gives you rights that these terms cannot restrict, those rights stand.
We may update these terms from time to time. When we do, the "last updated" date at the top of this page changes with it, and the revised terms are posted here.
Continued use of your service after an update constitutes acceptance of the revised terms. Where a change materially affects your rights or what you pay, we will tell account holders directly rather than rely on you noticing the date.
If anything here is unclear, ask before you buy rather than after. Open a ticket and it will be tracked against your account, so whoever answers can see the services it concerns.
